Privacy Policy

This is the YagattaTalk Privacy Policy ("Policy"). This Policy applies to your use of our website (the "Site") and our YagattaTalk service (the "Service"). Using the Service requires that you install our software on your computer or device (the "Software"). When using our Site, Service, or Software you agree to this Policy and the Terms of Service (which can be found at Terms of Service). The Site, Service, and Software are provided by Qualcomm iSkoot, Inc., a company headquartered in California, U.S.A. ("we", "us" or "our").

US Safe Harbor Registration:

The United States Department of Commerce has agreed with the European Commission and the government of Switzerland on a set of data protection principles and frequently asked questions to enable U.S. companies to satisfy the requirements under European Union law and Swiss law that adequate protection be given to personal information transferred from the European Economic Area ("EEA") and/or Switzerland to the United States (collectively the "Safe Harbor"). The EEA and Switzerland have recognized the Safe Harbor as providing adequate data protection. Consistent with its commitment to protect personal privacy, iSkoot adheres to the principles set forth in the Safe Harbor.

Data We Collect.

Service Registration & Set-Up:

To provide our Service and create your account, we may collect certain information during registration and set-up such as your first and last name, mobile telephone number, email address, mobile device make, model, unique identifier, software version and wireless service provider.

The Service may allow you to connect or invite people within your contacts files, for example, through your phone or computer ("Contacts"). In such case, you may choose to have us send your Contacts an invitation to use our Service and that information will be stored on our servers.

Use of the Service.

As you use our Service, the information you share with others will pass through and be stored on our servers in order to enable us to provide the Service. We will also collect information about how you use our Service such as the frequency and duration of use, the types and sizes of the files you use with our Service, and the features of the Service that you use. Finally, to improve performance, our Software on your device will periodically connect to our computer servers even while you are not actively using our Software in order to help maintain the operation of the Service. You can temporarily disable this periodic connection to our servers by force stopping the application on your device; the connection to our servers will resume the next time you launch the application or receive a message from a YagattaTalk user.

Information You Submit.

If you voluntarily submit information to us-for example, if you participate in a survey, provide us feedback, send us questions, supply additional information to your account or profile, or respond to our request for information-we will collect the information you submit. In each such instance, you will know what data we collect, because you actively submit it. We will use the data you voluntarily submit to us for the purposes we describe in this Policy, as well as any purposes that we describe to you when we collect such information. We may also use comments or feedback you voluntarily provide us about our products and services (including your name if you provide it) in our advertising, marketing, or promotional materials.

Operation of the Site.

As part of the standard operation of the Site, we may collect information from your computer or device, including but not limited to your browser type, operating system, IP address and the domain name from which you accessed the Site, and, if you are accessing our Site with your mobile device, type of mobile device. In addition, we may collect information about your browsing behavior, such as the date and time you visit the Site, the areas or pages of the Site that you visit, the amount of time you spend viewing the Site, the number of times you return to the Site and other click-stream data.

Cookies.

We may use cookies on our Site to collect the information described above. A cookie is a small text file that may be stored on the hard drive of your computer or device when you access the Site. We may use cookies to: (1) monitor Site usage; (2) remember you when you return to the Site; and (3) conduct research to improve our Site and services.

We may also allow other companies such as web analytics partners, advertisers, or ad networks to set or access their cookies or Web beacons (also referred to as 1x1 pixel.gifs or action tags) on the Site. For example, we may use third party advertising companies to serve ads on our behalf across the Internet or to display ads for other companies on our Site. This information may include: date/time of banner ad shown, their cookie, and the first three octets of the IP address. Cross-Border Transfer.

The information we collect is stored and processed on servers in the United States and may be transferred to other locations around the world. By using the Service you consent to the transfer of the information described in this Policy to locations that may be outside of the country in which you live, and such places may be in the United States, within one or more European countries, and/or in one or more countries within Asia.

Use of Data.

In addition to the other uses of your information described in this Policy, we may use and process the data we collect for the following general purposes:

  1. To provide, protect, and improve our Service, Site, Software and our systems;
  2. To respond to requests that you may send us such as your request for information, your request for customer support, or your request to subscribe to a service we offer;

  4. To protect our rights and the rights of our users;
  5. To inform you about our products and services; and
  6. Any other use we describe at the point where we collect the data.

To the extent permitted by applicable law, we reserve the right to combine the various types of data that we collect and to combine the data that we collect with data that we obtain from third parties or other sources. We may use the combined data for any of the purposes described in this Policy.

Data Sharing.

We do not share your personally identifiable information with others, except as follows: We may share your information with agents, service providers, vendors, contractors, or affiliates who process the data only on our behalf for the purposes set forth in this Policy. We may also share your information as required by law or in the interest of protecting or exercising our or others' legal rights, e.g., without limitation, in connection with requests from law enforcement officials and in connection with court proceedings. We may share or transfer your information in connection with a prospective or actual sale, merger, transfer or other reorganization of all or parts of our business. Finally, we may also share your personal information where you have granted us permission. We may also de-identify the data we collect by removing personally identifying information and share such anonymous data with third parties such as business partners, the press, or public for our business purposes.

Forums & Blogs.

Our Site may provide a forum, blog, or other interactive feature that allows you to disclose information directly to us and other users of the Site. Your participation in such interactive features is completely voluntary and we assume no obligations or responsibility with respect to the information you provide or share through such interactive features. To participate in these interactive features, we may require you to register with us and provide certain information such as your name, email address, location, phone number, and desired display name (which may be viewable by other users of the interactive features). We or our service providers acting on our behalf may use the information you provide during the registration process for analytical and development purposes (such as to make product or service enhancements) and to enable you to use the interactive features and to manage your account. You may also personalize our interactive features by voluntarily providing additional information such as your location, instant message contact information, website address, occupation, and other information. Our interactive features may also allow you to upload an avatar or other graphical representation of yourself. If you voluntarily provide such additional information, it may be viewable by other users of the interactive features - so you should not provide information you do not want other users to know.

Links.

The Site or Service may provide links to third party web sites that we do not own or operate. Such links may include, but are not limited to, advertising, sponsorships, promotions, recommendations, or links to other third party content ("Third Party Sites"). The Third Party Sites and the data that they collect and that you provide them are governed by the privacy policies of such Third Party Sites and not this Policy.

Promotions & Surveys.

In connection with promotions, surveys, or other projects, we may ask you whether you object to our specified data use or sharing. If you opt-out under such circumstances, we will respect your decision. Please note that our affiliates and other data recipients have their own data privacy policies, which may differ from ours and you would have to contact them separately with respect to opt-out requests.

Closing Your Account & Data Delete.

If you do not want us to collect, use, and share the information we describe in this Policy, please contact us to close your account, discontinue your use of our Site and Service, and remove our Software from your device using standard uninstall procedures. Please see the Contact Us paragraph below for instructions on how to contact us. After receipt of your request to close your account, we will delete the information in your account from the Service within a reasonable time. Please note, however, closing your account will not affect other users' accounts; any information such as text or voice messages, images, or other content you have chosen to share with others may remain in their accounts.

Notwithstanding the foregoing, there may be circumstances where we are legally required to retain the information we collect about you (for example, in connection with court proceedings and law enforcement actions) and despite your request for us to delete your information, we will retain what we are legally required to keep. Moreover, we reserve the right to de-identify the information so that it is no longer associated with you rather than deleting it. We also reserve the right to use previously obtained information to verify your identity or take other actions that we believe are appropriate. Finally, please note, that we cannot delete any information you post from our Service to external services, and you must separately remove that information from those external services if you no longer want it available through those services.

Security.

Transmissions over the Internet are never 100% secure or error-free. However, we take reasonable steps to protect your personal information from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. It is your responsibility to safeguard your account login credentials for access to the Site and/or Service and to notify us if you ever suspect that your login credentials have been compromised. You are solely responsible for any unauthorized use of your account with the Site and/or Service conducted via your login credentials.

Children's Privacy.

We do not direct the Site or Service to, nor do we knowingly collect any personal information from, children under thirteen.

Changes.

We may change this Policy from time to time and in our sole discretion. If we materially change this Policy with respect to your personal information, we will provide appropriate online notice to you (for example, to your mobile device) and give you a choice with respect to the change. When we make changes to this Policy, we will alert you that changes have been made by indicating on the Policy the date it was last updated. When you use our Site and/or Service, you are accepting the current version of this Policy as available through the Site or "My Profile" feature of the Service at that time. We recommend that users revisit this Policy occasionally to learn of any changes.

Safe Harbor Dispute Resolution.

We participate in the EU and Swiss Safe Harbor Privacy Framework as set forth by the United States Department of Commerce. As part of our participation in the safe harbor, we have agreed to TRUSTe dispute resolution for disputes relating to our compliance with the Safe Harbor Privacy Framework. If you have any complaints regarding our compliance with the Safe Harbor you should first contact us (as provided above). If contacting us does not resolve your complaint, you may raise your complaint with TRUSTe by Internet here, fax to 415-520-3420, or mail to TRUSTe Safe Harbor Compliance Dept., click for mailing address. If you are faxing or mailing TRUSTe to lodge a complaint, you must include the following information: the name of company, the alleged privacy violation, your contact information, and whether you would like the particulars of your complaint shared with the company. For information about TRUSTe or the operation of TRUSTe's dispute resolution process, click here or request this information from TRUSTe at any of the addresses listed above. The TRUSTe dispute resolution process shall be conducted in English. For human resources data we have agreed to cooperate with data Protection Authorities.
